Please read these Terms and Conditions carefully before using Espoir Health's services. By accessing our website or engaging with our patient coordination services, you agree to be bound by these terms.

Acceptance of Terms

By accessing the Espoir Health website, submitting an enquiry form, contacting us via WhatsApp or email, or engaging with any of our patient coordination services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

Agreement: If you do not agree to any part of these Terms and Conditions, please do not use our website or services. Your continued use constitutes acceptance of these terms.

These terms apply to all visitors, users, and patients who access or use Espoir Health's services. We reserve the right to update these terms at any time, with the updated version taking effect upon publication on our website.

Our Services

Espoir Health provides medical tourism facilitation and patient coordination services. Our services include, but are not limited to:

Free initial consultation and medical case review to assess treatment options and estimated costs.
Facilitation of appointments with specialist doctors and partner hospitals in Delhi, India.
Assistance with medical visa documentation, travel arrangements, and local accommodation coordination.
On-ground patient support and coordination during your treatment stay in Delhi.
Post-treatment follow-up support and remote consultation facilitation.

We specialise in Cardiology, Oncology, Nephrology, and IVF Treatment, coordinating care across our five partner hospitals: Metro Hospital, Artemis Hospital, Sarvodaya Hospital, Neelkanth Hospital, and Fortis Hospital.

Not a Healthcare Provider

Important Disclaimer: Espoir Health is a medical tourism facilitator and patient coordinator. We are NOT a hospital, clinic, or direct healthcare provider. We do not diagnose, treat, prescribe, or provide medical advice.

All medical decisions, diagnoses, treatment plans, and clinical care are the sole responsibility of the qualified medical professionals and hospitals with whom you are connected. Espoir Health acts solely as an intermediary and coordination service.

Any information provided by Espoir Health is for general informational purposes only and does not constitute medical advice.
You should always consult with a qualified medical professional before making any healthcare decisions.
Treatment outcomes, medical results, and clinical decisions are entirely the responsibility of the treating hospital and doctors.

User Obligations

By using Espoir Health's services, you agree to the following obligations:

Accurate Information: You agree to provide truthful, accurate, and complete information about your medical condition, identity, and contact details. Providing false or misleading medical information may affect the quality of care coordination and could be harmful to your health.

Lawful Use: You agree to use our website and services only for lawful purposes and in a manner that does not infringe the rights of others.

No Harmful Activity: You agree not to engage in any activity that could damage, disable, or impair our website, systems, or reputation.

Timely Communication: You agree to respond promptly to requests for additional information required to facilitate your medical coordination.

Travel & Visa Responsibility: You are responsible for ensuring you have the appropriate visa, travel documents, and travel insurance for your medical journey to India.

Medical Compliance: You agree to follow the medical advice and instructions provided by the treating doctors and hospitals throughout your treatment.

Payments & Fees

Free Consultation: Your initial consultation with Espoir Health's coordination team is completely free of charge. There is no commitment required at the enquiry stage.
Medical Treatment Costs: All treatment, hospital, and procedure costs are paid directly to the treating hospital and are subject to the hospital's own pricing, policies, and payment terms.
Facilitation Fees: Any coordination or facilitation fees charged by Espoir Health will be clearly communicated in writing before any commitment is made. We maintain full transparency on all charges.
Cost Estimates: Any cost estimates provided by Espoir Health are indicative only and subject to change based on final medical assessment by the treating hospital and specialists.
Refund Policy: Refund terms, if applicable, will be communicated clearly in your individual service agreement. Travel and accommodation costs are subject to the respective provider's cancellation policies.
Currency: Cost estimates may be provided in Indian Rupees (INR) or US Dollars (USD). Exchange rate fluctuations are the responsibility of the patient.

Limitation of Liability

To the fullest extent permitted by applicable law, Espoir Health, its directors, employees, and agents shall not be liable for:

Any medical outcomes, complications, side effects, or treatment results arising from care provided by partner hospitals or doctors.
Any direct, indirect, incidental, or consequential damages arising from your use of our services or website.
Delays, cancellations, or changes to medical appointments, travel, or accommodation arrangements beyond our reasonable control.
Loss or damage resulting from reliance on information provided on our website, which is for general informational purposes only.
Visa denials, travel disruptions, or failure to obtain necessary documentation from third-party authorities.
Espoir Health's maximum aggregate liability to any user shall not exceed the total facilitation fees paid to Espoir Health in the three months preceding the event giving rise to the claim.

Intellectual Property

All content on the Espoir Health website — including but not limited to text, graphics, logos, icons, images, and page layouts — is the property of Espoir Health and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or commercially exploit any content from our website without prior written permission from Espoir Health.
The Espoir Health name, logo, and brand identity are proprietary trademarks and may not be used without written consent.
You are permitted to view and print pages from our website for personal, non-commercial use only.

Third-Party Services

Espoir Health works with third-party partners — including hospitals, airlines, accommodation providers, and technology platforms — to deliver our services. Please note:

Third-party hospitals and service providers operate under their own terms, conditions, and policies. We encourage you to review them before engaging directly.
Our website may contain links to external websites. Espoir Health is not responsible for the content, accuracy, or privacy practices of any third-party websites.
Espoir Health does not endorse or guarantee the quality of any third-party services beyond our due diligence and established partnerships.

Termination

Either party may terminate the service engagement at any time, subject to the following conditions:

By You: You may discontinue using our services at any time by notifying us in writing. Any costs already incurred (e.g., hospital consultation fees, travel bookings) remain your responsibility.
By Espoir Health: We reserve the right to refuse or discontinue services to any individual who provides false information, engages in abusive behaviour, or violates these Terms and Conditions.
Effect of Termination: Upon termination, obligations that by their nature should survive will remain in effect, including confidentiality, liability limitations, and intellectual property rights.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms or your use of Espoir Health's services shall be subject to:

Jurisdiction
Courts of New Delhi, India shall have exclusive jurisdiction over any disputes.
Governing Law
Laws of the Republic of India, including the IT Act 2000 and Consumer Protection Act 2019.
Dispute Resolution
We encourage good-faith resolution of disputes before initiating any formal legal proceedings.
Language
These Terms are written in English. In case of any translation discrepancy, the English version prevails.
